Magda Cloete’s practice centres on opposed debt review litigation, legal analysis and the interpretation of the National Credit Act. She combines courtroom advocacy with specialist postgraduate research, bringing a questioning mind, thorough preparation and a commitment to well-founded legal argument to complex matters.
Biography
Magda Cloete joined VDH in 2016, expecting a temporary placement while awaitingher admission as an attorney. Instead, she discovered an area of law that wouldbecome her professional passion. What began as a brief stop between career stagesdeveloped into a lasting commitment to debt review litigation and the work of thefirm.
Magda holds an LLB and an LLM in Mercantile Law from the University of Pretoria. She completed her articles at Fasken Martineau in Johannesburg and was admittedas an attorney of the High Court in 2016.
Her LLM dissertation, The Delay of Debt Review Referrals in the Magistrates’ Courts, was completed under her maiden surname, Birkholtz, in 2020 and examinedpractical and interpretative challenges affecting the finalisation of debt reviewapplications.
Her career at VDH developed through hands-on experience across the court-application process. Beginning with the drafting of applications, she progressed tocourt management work before appearing in courts across South Africa. That progression gave her a detailed understanding of how preparation, procedure andlegal argument connect in practice.
Magda’s particular focus within the firm lies at the intersection of litigation, legaldevelopment and implementation. She is closely involved in analysing developmentsin debt review law, developing the firm’s legal response to difficult or contestedissues and translating those positions into practical guidance, training and processesfor the attorneys responsible for implementing them.
As a director, she also contributes to professional training, the development of legalarguments and the refinement of internal legal processes. She values equippingattorneys and debt counsellors with the understanding to approach difficult mattersconfidently, while remaining clear about their professional responsibilities.
For Magda, the appeal of debt review lies in its unusual combination of technicallegal complexity and practical consequence: an area in which statutoryinterpretation, procedure and legal principle have immediate consequences for thepeople and institutions operating within the debt review process.
Our Attorneys
The People Behind the Process
VDH's legal team brings together attorneys with extensive experience in debt review litigation, court appearances, opposed proceedings, legal research, regulatory matters and the practical application of the National Credit Act.
Our attorneys operate across the Western Cape, Gauteng and Limpopo and are supported by specialised litigation, court-management and administrative teams.
Some members of the firm have spent the majority of their legal careers working in debt review. Others bring experience from general litigation, prosecution, the Magistracy, advocacy, regulatory work and other areas of legal practice.
That combination is deliberate.
Debt review litigation does not happen in isolation. It requires an understanding of civil procedure, consumer-credit law, evidence, enforcement, court practice and the practical financial circumstances underlying each application.

Careers
Build a Career in Specialist Litigation
VDH operates at the intersection of law, litigation, technology and legal process design built around a specialist field.
For attorneys, candidate attorneys and legal professionals, that creates an environment very different from a traditional general practice.
Our team works with high volumes of litigation, but the work is not simply administrative. Attorneys are exposed to court appearances, opposed matters, developing questions under the National Credit Act, legal research, drafting, negotiation and the practical challenges that arise when legislation is applied across courts throughout South Africa.
We are particularly suited to people who are:
-
intellectually curious;
-
practical problem-solvers;
-
comfortable taking responsibility;
-
interested in litigation and legal argument;
-
willing to question inefficient processes;
-
able to work accurately at scale; and
-
committed to maintaining professional standards in a highly specialised practice.
-
VDH has grown by developing people internally and giving talented individuals the opportunity to take ownership of meaningful work.
If specialist litigation, legal technology and the continuing development of South African debt review law interest you, we would like to hear from you.
